Americans With Disabilities Act (ADA)

  •  The ADA outlaws discrimination and guarantees that people with disabilities have the same opportunities as everyone   else to participate in all aspects of everyday life.
  • The ADA is one of the several laws that  protect the employment and other rights of people with disabilities
  • The Act was put into place on July 26,1990, was when it was first passed



Definition of Disablilty

  • A person may be disabled if he or she has a physical or mental condition that substantially limits a major life activity (walking, talking, seeing, hearing, or learning)
  • A person may be disabled if he or she has a history of a disability (cancer that is in remission)
  • A person may be disabled if they are believed to have a physical or mental impairment within the last six months



Disability Discrimiation in the Workplace

  • Discrimination occurs a lot in the work place
  • Disability discrimination occurs when a covered employer treats an applicant or employee less favorable because they have a history of a disability
  • In other words the law, states that all people with disabilities are treated as equal as normal people in a workplace



Disability Harassment 

  • It is illegal to harass an applicant or employee because he has a disability, had a disability in the past, or is believed to have a physical or mental impairment
  • Harassment can include offensive remarks about a person disability
  • May be considered teasing and offhand comments that are not needed to be said

Interview Notes

  • Do people with disabilities have different benefits?
  • Do people with disabilities need the same amount of education as normal people?
  • Do they get more vacation time off, because of their health?
  • Can people with a disability have a driver's license?
  • If a disabled person receives social security benefits, can they still work?

Other Information

  • Individuals with disabilities must be allowed to have the same opportunity to participate in a public entity’s programs and services the same as anyone else.
  • Reasonable accommodation to an employee or job applicant with a disability, unless doing so would cause significant difficulty or expense for the employer
